Maritime Safety Act 2005 - Guidance Note for Local Authorities

The Maritime Safety Directorate has drafted guidelines on the powers available to local authorities and other relevant authorities to regulate craft such as fast powercraft and personal watercraft taking into account the Maritime Safety Act 2005. The aim of theses guidelines is to: (i) assist local authorities, inland water bodies & port and harbour authorities in the proper management of water resources through the introduction by them of bye-laws under the Maritime Safety Act 2005 which would deal with all aspects of the local use of mechanically powered recreational craft; (ii) inform the authority making the bye-laws on issues relating to the design, implementation and management of such bye-laws. Merchant Shipping Acts 1894 2005

Consolidated working text of the extant provisions of the above Acts

The Maritime Safety Directorate have compiled a comprehensive set of documents incorporating all the changes that have been enacted in the provisions of the Merchant Shipping Acts from 1894 to 2005.  The text has been prepared to facilitate a comprehensive review of the legislation in order to update the legal provisions.  The ultimate aim is to consolidate into a single Act. 

The documents have been divided by subject headings for ease of reference and are listed by links below.  Each subject heading contains two documents  - Document 1 and Appendix.

Document 1

· contains an introduction

· contains an index listing all the extant sections of the each of the Merchant Shipping Acts, in chronological order,  relevant to the subject heading
· provides a consolidated and annotated text of the extant provisions in chronological order, highlighting in bold italics
- the repeals or amendments to each provision, if any
- any other provisions in subsequent Acts which are of  general application. (Refer to the Appendix for full text of these other provisions).
Appendix

This document contains the full text of provisions, other than provisions providing for direct amendments, which are of general application in respect of each of the extant sections of the Merchant Shipping Acts.
